Indonesia's draft Ministry of Industry regulation for lead-acid motor-vehicle batteries in categories M, N, O and L may affect manufacturers and importers. A draft is not automatically effective law, so companies should distinguish proposed requirements from a promulgated final regulation.
Proposed regulatory framework
The draft refers to SNI 38:2025 and SNI 4326:2025. Its proposed Type 5 conformity assessment framework includes factory audits, management-system reviews, product testing, an SNI Certificate and a separate approval to use the SNI mark.
The document also addresses domestic and imported products, exemptions and transition provisions.
Manufacturers and trademark holders
Factories should assess manufacturing authorization, facilities, testing equipment, ISO 9001 or IATF 16949 and ISO 14001. Class 9 trademark ownership matters because ordinary manufacturer-owned brands are treated differently from trademark cooperation and contract manufacturing.
Multiple manufacturing locations must be identified early when developing a compliance plan.
Authorized Representatives and importers
Overseas manufacturers would operate through an Indonesian Authorized Representative under the draft. An AR may import or appoint qualified importers for specified purposes, but vehicle-assembly imports and aftermarket imports have different eligibility requirements.
The proposed aftermarket route includes business-activity classification and a distribution agreement with the vehicle-brand owner or authorized party. Independent aftermarket models require careful legal clarification.
Early preparation without overclaiming
A readiness assessment can begin before final promulgation by reviewing model lists, quality certificates, trademarks, manufacturing details and existing reports.
Do not advertise a definite effective date, cost or guaranteed approval without final official evidence.
Transitions, exclusions and regulatory tracking
The draft contains transitional arrangements for certificates under earlier standards and limited exclusions for certification samples or research samples. A sample exception should not be treated as a general permission to sell products. Companies should retain genuine production and import dates where transitional provisions may be relevant.
Before quoting a transition deadline in a contract, verify the final promulgated wording and effective date. Website content should also be updated when regulations change so prospective manufacturers do not rely on outdated statements.
Frequently Asked Questions
Is the draft already mandatory law?
Its status must be checked against the final promulgated rule. A technical standard alone does not prove mandatory enforcement.
Can an aftermarket importer simply be appointed by an AR?
The draft allows appointed importers for specific purposes, with additional eligibility requirements for aftermarket imports.
